İşbu Aydınlatma Metni, 07/04/2016 tarihli ve 29677 sayılı Resmi Gazete’de yayımlanan 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) uyarınca veri sorumlusu sıfatını haiz NUKAI LABS FZ-LLC (“Şirket”) tarafından hazırlanmıştır.
Bu metin, AstroMera mobil uygulamasını (“Mobil Uygulama”) kullanan gerçek kişilerin kişisel verilerinin işlenmesine ilişkin olarak KVKK’nın 10. maddesi kapsamında aydınlatma yükümlülüğünün yerine getirilmesi amacıyla sunulmaktadır.

Kullanım ve İşlem Verileri
- Oluşturulan rapor ve analiz geçmişi
- Uygulama kullanım bilgileri
- Oturum bilgileri
- Bildirim tercihleri
Teknik ve Cihaz Verileri
- Cihaz türü
- İşletim sistemi bilgisi
- Uygulama sürümü
- Uygulama kullanımına ilişkin teknik performans verileri
Kişisel verileriniz Mobil Uygulama üzerinden, dijital sistemler aracılığıyla ve teknik altyapı hizmetleri kapsamında tamamen veya kısmen otomatik yollarla toplanmaktadır.
3. Kişisel Verilerin İşlenme Amaçları
Kişisel verileriniz aşağıdaki amaçlarla işlenmektedir:
- Mobil Uygulama üyeliğinin oluşturulması ve yönetilmesi
- Doğum bilgilerinize dayalı astrolojik analizlerin gerçekleştirilmesi
- Kullanıcılara kişiye özel rapor ve içeriklerin sunulması
- Yapay zeka destekli sistemler aracılığıyla analiz ve içerik üretim süreçlerinin yürütülmesi
- Kullanıcı deneyiminin geliştirilmesi ve hizmet kalitesinin artırılması
- Kullanıcı tercihleri doğrultusunda bildirim gönderilmesi
- Sistem güvenliğinin sağlanması ve bilgi güvenliği süreçlerinin yürütülmesi
- Hukuki yükümlülüklerin yerine getirilmesi
4. Kişisel Verilerin İşlenmesinin Hukuki Sebepleri
Kişisel verileriniz KVKK’nın 5. maddesi kapsamında aşağıdaki hukuki sebeplere dayanılarak işlenmektedir:
- Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması
- Şirketimizin hukuki yükümlülüklerini yerine getirebilmesi
- Şirketimizin meşru menfaatlerinin bulunması (temel hak ve özgürlüklerinize zarar vermemek kaydıyla)
- Kanunlarda açıkça öngörülmesi
- Gerekli hallerde ilgili kişinin açık rızasının bulunması
5. Kişisel Verilerin Aktarılması
Kişisel verileriniz, yukarıda belirtilen amaçların yerine getirilebilmesi için ve KVKK’nın 8. ve 9. maddelerine uygun olarak aşağıdaki taraflara aktarılabilmektedir:
- Astrolojik hesaplama hizmeti sağlayıcıları
- Yapay zeka destekli analiz ve içerik üretim hizmeti sağlayıcıları
- Bulut ve teknik altyapı hizmet sağlayıcıları
- Hukuken yetkili kamu kurum ve kuruluşları
- Şirketimizin faaliyetlerini yürütmek amacıyla hizmet aldığı iş ortakları
Hizmetin teknik olarak sunulabilmesi amacıyla bazı kişisel verileriniz yurt dışında yerleşik hizmet sağlayıcıları ile paylaşılabilmektedir. Bu aktarım faaliyetleri KVKK’nın 9. maddesi kapsamında ve gerekli güvenlik önlemleri alınarak gerçekleştirilmektedir.
6. Kişisel Verilerin Saklanma Süresi
Kişisel verileriniz;
- Mobil Uygulama üyeliğiniz süresince
- Üyeliğin sona ermesini takiben ilgili mevzuatta öngörülen süreler boyunca veya işleme amacının gerektirdiği süre kadar
saklanmaktadır.
Saklama süresi sona eren kişisel veriler KVKK ve ilgili mevzuata uygun şekilde silinmekte, yok edilmekte veya anonim hale getirilmektedir.
7. KVKK Kapsamındaki Haklarınız
KVKK’nın 11. maddesi uyarınca veri sahibi olarak aşağıdaki haklara sahipsiniz:
- Kişisel verilerinizin işlenip işlenmediğini öğrenme
- İşlenmiş ise buna ilişkin bilgi talep etme
- İşlenme amacını ve amaca uygun kullanılıp kullanılmadığını öğrenme
- Yurt içinde veya yurt dışında aktarıldığı üçüncü kişileri bilme
- Eksik veya yanlış işlenmiş ise düzeltilmesini isteme
- KVKK’nın 7. maddesi kapsamında silinmesini veya yok edilmesini isteme
- Bu işlemlerin aktarıldığı üçüncü kişilere bildirilmesini talep etme
- Münhasıran otomatik sistemler aracılığıyla analiz edilmesi sonucu aleyhinize bir sonucun ortaya çıkmasına itiraz etme
- Kanuna aykırı işleme nedeniyle zarara uğramanız halinde zararın giderilmesini talep etme

Başvurularınız KVKK’nın 13. maddesi uyarınca en geç 30 gün içinde sonuçlandırılacaktır.
8. Metinde Yapılabilecek Değişiklikler
Şirketimiz, yürürlükteki mevzuat ve veri işleme süreçlerinde meydana gelebilecek değişiklikler doğrultusunda işbu Aydınlatma Metni’nde değişiklik yapma hakkını saklı tutar. Güncel metin Mobil Uygulama içinde veya ilgili internet sayfasında yayımlanacaktır.
This Clarification Text has been prepared by NUKAI LABS FZ-LLC (“Company”), acting as the data controller in accordance with the Law No. 6698 on the Protection of Personal Data (“KVKK”).
This text is provided to fulfill the clarification obligation under Article 10 of the KVKK for individuals using the AstroMera mobile application (“Mobile Application”).

- Operating system information
- Application version
- Technical performance data related to application usage
Your personal data is collected through the Mobile Application, via digital systems, and within the scope of technical infrastructure services fully or partially by automated means.
3. Purposes of Processing Personal Data
Your personal data is processed for the following purposes:
- Creation and management of Mobile Application membership
- Performance of astrological analysis based on your birth information
- Provision of personalized reports and content to users
- Execution of analysis and content production processes via AI-supported systems
- Improvement of user experience and enhancement of service quality
- Sending notifications in line with user preferences
- Ensuring system security and execution of information security processes
- Fulfillment of legal obligations
4. Legal Grounds for Processing Personal Data
Your personal data is processed based on the following legal grounds within the scope of Article 5 of the KVKK:
- Directly related to the establishment or performance of a contract
- Compliance with the Company's legal obligations
- Legitimate interests of the Company (provided that it does not harm your fundamental rights and freedoms)
- Explicitly provided for in the laws
- Explicit consent of the data subject where necessary
5. Transfer of Personal Data
Your personal data may be transferred to the following parties in accordance with Articles 8 and 9 of the KVKK for the fulfillment of the purposes stated above:
- Astrological calculation service providers
- AI-supported analysis and content production service providers
- Cloud and technical infrastructure service providers
- Legally authorized public institutions and organizations
- Business partners from whom our Company receives services to conduct its activities
For the technical provision of the service, some of your personal data may be shared with service providers located abroad. These transfer activities are carried out within the scope of Article 9 of the KVKK and by taking the necessary security measures.
6. Retention Period of Personal Data
Your personal data is stored:
- During your Mobile Application membership
- Following the termination of membership, for the periods stipulated in the relevant legislation or for the period required by the purpose of processing
Personal data whose retention period has expired is deleted, destroyed, or anonymized in accordance with the KVKK and relevant legislation.
7. Your Rights Under KVKK
As a data subject, under Article 11 of the KVKK, you have the following rights:
- To learn whether your personal data is being processed
- To request information if it has been processed
- To learn the purpose of processing and whether they are used for their intended purpose
- To know the third parties to whom it is transferred at home or abroad
- To request correction if it is incomplete or incorrectly processed
- To request deletion or destruction within the scope of Article 7 of the KVKK
- To request notification of these processes to third parties to whom it has been transferred
- To object to the occurrence of a result against you by analyzing it exclusively through automated systems
- To demand compensation for damages in case of loss due to unlawful processing

Your applications will be finalized within 30 days at the latest in accordance with Article 13 of the KVKK.
8. Changes to the Text
Our Company reserves the right to make changes to this Clarification Text in line with changes in the current legislation and data processing processes. The updated text will be published within the Mobile Application or on the relevant internet page.
